This website, promenadeestates.com (the "Site"), is operated by JPS Asset Management, Inc. ("JPS Asset Management," "we," "us," or "our"), the property management company for Promenade Estates, 2330-2332 W Glenrosa Ave, Phoenix, AZ 85015. These Terms of Service govern your use of the Site and of our text message program. Please read them carefully before using our service. By using the Site or enrolling in text messages, you agree to these Terms.

1. About Us

JPS Asset Management, Inc. manages Promenade Estates, along with the Phoenix communities Desert Sky Estates and Whispering Palms Estates. JPS Asset Management, Inc. operates this Site and sends Promenade Estates text messages.

2. General Information Only – Not a Lease or Offer

Information on this Site is for general informational purposes only. Nothing on the Site is a lease agreement, an offer to rent, or a guarantee of availability, pricing, fees, or promotions. All rental terms may change and are not final until all parties sign a written lease.

3. Rental Applications and Fair Housing

Applications may be subject to identity, income, rental history, credit, and background screening, and requirements may change without notice. Submitting an application does not guarantee approval or availability. We comply with all federal, state, and local Fair Housing laws. We do not discriminate based on race, color, religion, sex, national origin, familial status, disability, or any other protected class.

4. Maintenance Requests

Online maintenance requests are handled during normal business hours and are not for emergencies. Report emergency maintenance by calling the Promenade Estates office at (602) 230-8539 or as instructed in your lease. Do not report emergencies by text message.

5. Text Message (SMS) Terms

5.1 Service description. JPS Asset Management, Inc. sends text messages to residents and applicants of Promenade Estates who opt in, from 602-786-8898. Messages are account notifications and reminders, such as rent and balance reminders, maintenance and service-request updates, lease and application updates, and important or urgent community notices. Messages may be in English, Spanish, or both. We do not send marketing or promotional texts through this program.

5.2 Consent to receive messages. You opt in by checking the optional SMS consent box on our Request a Tour form, by accepting the text consent disclaimer in our Rent Manager resident portal or online application, or by signing a written form with text consent. By opting in, you consent to receive text messages from JPS Asset Management, Inc., which may be sent using automated technology. Consent is not a condition of leasing or of receiving any housing services.

5.3 Message frequency and cost. Message frequency varies. Message and data rates may apply.

5.4 Opt-out. You can opt out at any time by replying STOP to any message. You'll get one message confirming the opt-out. You can also opt out by calling (602) 230-8539 or emailing jesseka@promenadeestates.com.

5.5 Help. Reply HELP to any message for more information, or contact us at (602) 230-8539 / jesseka@promenadeestates.com.

5.6 Carrier disclaimer. Operators are not liable for any delayed or undelivered messages.

5.7 Your number. You agree to tell us if your mobile number changes, and you confirm that you are the account holder or an authorized user of the number you provide.

5.8 Privacy. We respect your privacy and use your information only to provide the service. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text messaging opt-in data and consent will not be shared with any third parties. 5.9 Prohibited content. Our messages will never contain content related to sex, hate, alcohol, firearms, or tobacco.

6. CTIA Compliance

Our service complies with CTIA guidelines. Please report any concerns to us using the contact information in Section 14.

7. User Responsibilities

You agree not to submit false or misleading information, interfere with or disrupt the Site, try to access restricted areas, or use the Site for unlawful, abusive, or harmful purposes.

8. Third-Party Links and Services

The Site links to third-party websites and services, including our Rent Manager resident portal and online application. We are not responsible for their content, policies, or practices.

9. Accuracy of Information

We try to keep the Site accurate and up to date, but we do not guarantee availability, pricing, promotions, photos, floor plans, or uninterrupted access. All information may change without notice.

10. Limitation of Liability

To the fullest extent permitted by Arizona law, JPS Asset Management, Inc. and Promenade Estates are not liable for damages arising from use of, or inability to use, the Site or the text program, including delayed or undelivered messages. Nothing in these Terms limits liability for fraud, intentional misconduct, or other liabilities that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless JPS Asset Management, Inc., Promenade Estates, and their employees from claims arising from your misuse of the Site or your violation of these Terms.

12. Termination

We may suspend or end your access to the Site or the text program if you violate these Terms.

13. Governing Law; Changes

These Terms are governed by the laws of the State of Arizona. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona. We may update these Terms from time to time to reflect changes in our service or applicable laws. We will post the updated version here with a new Effective Date, and your continued use after changes are posted means you accept them.
